I. General provisions

  1. This Privacy Policy sets out how Artsun.games collects, processes and stores personal data necessary to provide services electronically through its website in the domain artsun.games (hereinafter: Service).
  2. The administrator of Users’ personal data is Artsun Maciej Czaplicki with registered office in Ząbki, Świerkowa 2 Street, with NIP number: 5222417105, REGON number: 141028472 (hereinafter: Administrator).
  3. Personal data are processed in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation) (hereinafter: RODO).
  4. The data collected by the Administrator will be:
    • processed in accordance with the law,
    • processed for clearly defined purposes and not subjected to further processing incompatible with those purposes,
    • substantively correct and adequate in relation to the purposes for which they are processed, kept no longer than necessary to achieve the purpose of processing

II. Purpose and legal basis of data processing

  1. The Administrator processes personal data necessary for the provision and development of the offered services available through the Website and its individual functionalities.
  2. Personal data will be processed for the following purposes:
    • account registration, verification of the User’s identity and implementation of the agreement on provision of services by electronic means in accordance with the Act of 18 July 2002 on provision of services by electronic means, including, in particular, by providing the possibility to use the User’s account – on the basis of acceptance of the terms and conditions of the Regulations (Article 6(1)(b) RODO);
    • communicating with the User in order to provide him/her with necessary information and to build positive and reliable relations with him/her, which constitutes the legitimate interest of the Administrator (Article 6(1)(f) RODO);
    • to promote the Administrator’s own products and/or services and those of its Partners by directing Marketing Information (newsletter) via e-mail, provided that the User has consented to receive such notifications via e-mail (Article 6(1)(a) RODO);
    • To grant access to information on news from the industry directly related to the Administrator’s business, provided that the User has consented to receive such notifications via e-mail (Article 6(1)(a) of the RODO),
    • for analytical and statistical purposes on the basis of the Administrator’s legitimate interest consisting in conducting verification of Users’ activity and preferences for optimization of services and products and applied functionalities of the Service (Article 6 (1)(f) RODO);
    • possible establishment, investigation of claims or defense against them on the basis of the Administrator’s legitimate interest consisting in the protection of its rights (Article 6 (1)(f) RODO).
    • The execution of an order placed by a customer in the online store, including contact via e-mail or telephone with the customer regarding an order placed in the online store.
  3. In each of the aforementioned cases (paragraph 2), providing data is voluntary, but necessary to conclude a contract or use other functionalities of the Website.

III. Period of personal data processing

  1. Personal data will be processed for the period during which a person remains an active User of the Website (has a User account), and after that time for the period necessary for compliance with the law, investigation or defense against possible claims, but no longer than 3 years counted from the date of termination of the agreement on provision of electronic services.
  2. Data processed on the basis of consent will be processed until the withdrawal of the granted consent, with the proviso that the withdrawal of this consent does not affect the compliance of data processing, which was performed before this withdrawal.

IV. Information about processing

  1. Personal data, depending on the purpose of processing, may be disclosed:
    • entities related to the Administrator
    • entities cooperating with the Administrator,
    • to subcontractors, in particular to entities providing and operating selected IT systems and solutions,
    • entities handling online payments,
    • entities providing courier and postal services,
    • law firms.
  2. Personal data processed by the Administrator, will be transferred outside the European Economic Area and may be transferred to international organizations (in particular, this applies to data related to website traffic analysis processed by Google and website integration with Facebook, Instagram and Youtube).

V. Rights of data subjects

  1. The User of the Website has the right to:
    • access to the content of their personal data
    • rectification of data
    • deletion of data
    • restriction of data processing
    • data portability
    • object to processing taking place on the basis of the controller’s legitimate interest
    • withdrawal of consent at any time without affecting the legality of processing carried out on the basis of such consent before its withdrawal
  2. The user has the right to lodge a complaint to the President of the Office for Personal Data Protection in a situation where he/she considers that the processing violates his/her rights and freedoms.
  3. Automated decision-making, including profiling, does not occur in data processing.

VI. Cookies

  1. The Website also uses cookie technology as part of the data processing described above. Cookies (so-called “cookies”) are IT data, in particular text files, which are stored in the Service User’s terminal equipment and are intended for use on the Website. Cookies usually contain the name of the website they come from, the time they are stored on the terminal equipment and a unique number.
  2. The entity placing cookies on the Service User’s terminal equipment and accessing them is the Administrator of this website.
  3. The Website uses two basic types of cookies: session cookies and persistent cookies. Session cookies are temporary files that are stored on the User’s terminal equipment until the User logs out, leaves the website or turns off the software (web browser). Persistent cookies are stored on the User’s end device for the time specified in the parameters of the cookies or until they are deleted by the User.
  4. The following types of cookies are used within the Service:
    • necessary cookies to enable the use of services available within the Service, e.g. authentication cookies used for services requiring authentication within the Service;
    • cookies used to ensure security, e.g. used to detect abuse of authentication within the Service;
    • performance cookies, making it possible to collect information on how the Website’s pages are used;
    • functional cookies, making it possible to remember the User’s selected settings and personalize the User’s interface, e.g. with regard to the chosen language or region of origin of the User, font size, appearance of the website, etc;

  6. The Operator of the Website informs that restrictions on the use of cookies may affect some functionalities available on the Website.

VII. Final Provisions

  1. The User will be informed about any changes in the Privacy Policy through an announcement available on the Website.
  2. The Administrator reserves the right to make changes to this Privacy Policy, at the same time ensuring that the Users’ rights under this document will not be restricted.
